• RCS services may only be used for legitimate business purposes, including promotional, transactional, and OTP messaging.
• Customers are prohibited from using the services for unlawful activities such as spam, fraud, or phishing.

3. Customer Responsibilities

• Customers must provide accurate and complete information during the registration process.
• Customers are responsible for obtaining proper consent from end users before sending messages via RCS.
• Customers must ensure that their content complies with all applicable laws, including opt-in/opt-out requirements.

4. Data Privacy and Security

• MIDHA BACKERS is committed to protecting customer data in accordance with our Privacy Policy.
• Customers must ensure the security of their accounts and safeguard login credentials.
• Sensitive data such as healthcare information should not be transmitted unless explicitly compliant with applicable laws.

5. Fees and Payments

• Charges for RCS services will depend on the type of message sent (e.g., basic RCS, rich content messages).
• All payments must be made promptly as per the agreed terms. Failure to pay may result in suspension or termination of services.

6. Intellectual Property

• All intellectual property rights related to our platform and services remain with MIDHA BACKERS.
• Customers retain ownership of their content but grant MIDHA BACKERS a license to use it solely for providing the agreed-upon services.

7. Service Availability

• MIDHA BACKERS strives to provide uninterrupted service but does not guarantee 100% uptime.
• We reserve the right to modify or discontinue any part of the service without prior notice.

8. Limitation of Liability

• MIDHA BACKERS is not liable for any indirect, incidental, or consequential damages arising from the use of our services.
• Our total liability is limited to the amount paid by the customer for the specific service in question.

9. Termination

• Either party may terminate the agreement by providing written notice.
• MIDHA BACKERS reserves the right to terminate or suspend services immediately in cases of non-compliance with these Terms or misuse of services.

10. Governing Law

These Terms are governed by and construed by the laws of Haryana’s Jurisdiction. Any disputes shall be resolved in Haryana’s Jurisdiction’s Courts.

11. Amendments

MIDHA BACKERS reserves the right to update these Terms at any time. Continued use of our services after changes constitute acceptance of the updated Terms.
